KANNAR Terms and Conditions

Acceptance and Acknowledgment

By accessing or using the KANNAR application, creating an account, or uploading any content, including advertisements, images, texts, or comments, you expressly and finally acknowledge and unconditionally agree to be fully bound by these Terms and Conditions and any subsequent amendments thereto, with full legal capacity as recognized by applicable law.

If you do not agree to these Terms, you must immediately cease using the application. Continued use of the application following any amendment shall constitute your acceptance of such amendment. No claim of ignorance of these Terms shall be accepted.

2. Eligibility and Age

You must have reached the legal age of majority in your country and possess full legal capacity to enter into contracts.

By using the application, you represent and warrant that you possess such legal capacity and that you alone shall bear any consequences arising from any violation of this requirement.

3. Nature of the Application and Disclaimer

KANNAR is a neutral and intermediary technology platform intended solely for displaying content and advertisements. Under no circumstances shall KANNAR be considered a publisher, editor, monitor, partner, agent, or representative of any user.

The application and its services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, without limitation, warranties of fitness for a particular purpose, non-infringement, or uninterrupted availability.

To the maximum extent permitted by applicable law, KANNAR's management fully, absolutely, and finally disclaims any and all liability for:

• Any content, image, advertisement, comment, or data uploaded or published by any user.

• Any transactions, agreements, interactions, or disputes occurring between users.

• Any direct, indirect, consequential, incidental, or special damages, including loss of profits, data, reputation, or any other losses, whether arising from the use of the application, reliance on its content, interruption of the service, technical errors, or any other cause.

Each user, service provider, or advertiser shall bear sole and full civil, criminal, financial, and regulatory responsibility for everything they publish, provide, or undertake, including the quality and reliability of their services or advertisements.

The management is not obligated to monitor content or services in advance and reserves the absolute right, at its sole discretion, to intervene or refrain from intervening.

4. Prohibited Activities and Zero-Tolerance Rules

The publication, practice, promotion, facilitation, or encouragement of any of the following is strictly and absolutely prohibited and shall constitute a serious violation subject to immediate action:

• Any content that insults, disrespects, or otherwise offends God, religions, prophets, or religious sanctities in any form.

• Any content that undermines national sovereignty or state security, incites unrest, or insults national symbols or leadership.

• Sexual insinuations, obscene or indecent materials, or the promotion or advertising of prostitution.

• Advertising, promoting, facilitating, or trading in drugs or any substances prohibited or restricted by law.

• Impersonation, deception, fraud, fake advertisements, or false information.

• Insults, slander, defamation, damage to the reputation of others, or publication of false information that causes harm to others.

• Extortion, threats, or attempts to obtain any material or non-material benefit in exchange for refraining from publishing content or information.

• Infringement of intellectual property rights, trademarks, or any rights belonging to third parties.

• Attempting to hack, compromise, or interfere with the application's systems or users' data, or sending malware or malicious software.

• Incitement to hatred or discrimination based on race, sect, tribe, or other protected characteristics.

• Sending spam or unsolicited messages, using the application for unauthorized commercial purposes, or collecting users' data without authorization.

• Any content or conduct that violates applicable laws, regulations, or legal requirements.

5. User Obligations and Account Security

The user must provide accurate, complete, and truthful information when registering, keep such information up to date, and maintain the complete confidentiality of their login credentials.

The user bears sole and absolute responsibility for all activities conducted through their account, whether carried out with or without their knowledge.

The user must immediately notify the management upon suspecting any unauthorized or unlawful use of their account.

The user acknowledges that all content they upload is either their own property or that they have full legal rights to publish it, and that such content does not infringe upon the rights of any third party.

6. Rights of the Application Management and Enforcement Measures

The management reserves the absolute and unrestricted right, without prior notice, compensation, or any obligation to provide reasons, to:

• Delete, remove, hide, or permanently disable any content that is deemed to be in violation, suspicious, or unwanted.

• Temporarily or permanently suspend or terminate an account and block associated IP addresses and devices.

• Retain all records, data, images, and communications and provide them promptly to security authorities, judicial authorities, or competent prosecution authorities when legally requested or where there is a reasonable suspicion of unlawful activity.

• Take any technical, legal, or administrative action it deems necessary to protect the application, its users, or the reputation of the platform.

• Refuse to publish any content or advertisement without providing reasons.

7. Content License and Intellectual Property

By uploading any content, you grant the application management a non-exclusive, worldwide, perpetual, royalty-free, sublicensable, and transferable license to use, display, store, reproduce, modify, translate, and distribute such content for the purposes of operating, maintaining, promoting, and protecting the application.

Ownership of the content remains with you. However, you shall bear sole and full responsibility for any claim arising from such content, and you represent and warrant that you own or otherwise possess all rights necessary to grant this license without restriction.

8. Data Protection and Privacy

Personal data shall be collected and processed in accordance with the application's separate Privacy Policy, which forms an integral part of these Terms and Conditions.

By using the application, you expressly consent to the processing of your data for the purposes stated in the Privacy Policy.

The management shall not be responsible for any disclosure or data breach resulting from the user's actions, the actions of a third party, or circumstances beyond its reasonable control.

9. Indemnification and Release

The user irrevocably and finally agrees to indemnify, defend, and hold harmless the application management, its employees, directors, agents, affiliates, and related entities from and against any claims, actions, losses, damages, liabilities, costs, or expenses, including reasonable attorneys' fees and litigation costs, arising in any manner from:

• The user's violation of these Terms and Conditions.

• Any content published or uploaded by the user.

• The user's use of the application.

• Any infringement of the rights of any third party.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the application management shall not be liable to any user or third party for any financial, legal, direct, indirect, incidental, consequential, special, or other damages of any kind.

If, notwithstanding the foregoing, any liability is established against the management, its total aggregate liability shall in no event exceed a nominal amount of one (1) monetary unit of the currency of the applicable jurisdiction or the amount of fees actually paid by the user during the preceding twelve (12) months, if any, whichever is lower.

11. Termination of Use

The user may terminate their account at any time.

The management may immediately terminate or suspend an account without notice upon any violation, suspected violation, or for any other reason it deems appropriate in its sole discretion.

Upon termination of the account, all provisions relating to disclaimers, indemnification, limitation of liability, intellectual property, jurisdiction, and confidentiality shall survive and remain in full force and effect.

12. Force Majeure

The management shall not be liable for any delay, interruption, or failure to perform resulting from circumstances beyond its reasonable control, including natural disasters, wars, civil unrest, major technical failures, cyberattacks, or decisions of governmental or judicial authorities.

13. Amendments, Jurisdiction, and Applicable Law

The management reserves the right to amend these Terms and Conditions at any time without prior notice.

Any amendments shall be published within or through the application and shall become effective and binding immediately upon publication. Continued use of the application following publication of the amendments shall constitute final acceptance of such amendments.

These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations applicable in the jurisdiction selected by the management. The courts of such jurisdiction shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms and Conditions, to the exclusion of the jurisdiction of any other courts.

The Arabic version shall be the official and binding version. In the event of any conflict or inconsistency between the Arabic version and any translation, the Arabic version shall prevail.

14. General Provisions

If any provision, or any part thereof, is determined by a competent authority to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

The failure or delay of the management to exercise any right shall not constitute a waiver of such right and shall not prevent the management from exercising it at a later time.

These Terms and Conditions constitute the entire and final agreement between the user and the management concerning the use of the application and supersede all prior written or oral agreements, understandings, or arrangements.

The user may not assign, transfer, or delegate these Terms and Conditions or any rights or obligations arising hereunder to any third party without the prior written consent of the management. The management may freely assign or transfer these Terms and Conditions.

The headings contained in these Terms and Conditions are provided for convenience and clarification only and shall not affect their interpretation.
